ScottHulse to Present June 24th Seminar Focused  on New U.S. Department of Labor Overtime Rule

June 15, 2016

EL PASO, TX – ScottHulse Law Firm’s labor and employment practice group will present a seminar focusing on the U.S. Department of Labor’s new Final Overtime Rule, Friday, June 24, from 8 a.m. to 10 a.m., at the El Paso Club in downtown El Paso.

The two-hour seminar for business owners, executives and managers, human resource professionals, in-house legal counsel, and accounting firms, is designed to educate employers and advisers regarding the requirements and implications of the DOL Final Overtime Rule, which was issued in mid-May. ScottHulse attorneys will outline strategies and tactics that can be used to protect businesses and organizations both legally and financially before the law goes into effect later this year.

The U.S. Department of Labor’s new Final Rule regarding overtime affects every business with “exempt” employees. The new rule redefines which white-collar employees, including executive, administrative, professional, outside sales and computer employees, are protected by the Fair Labor Standards Act (FLSA) minimum wage and overtime standards.

Seminar topics will include a briefing on the new Final Rule as compared to the old rule — what changed and didn’t change; and the critical issues, including the new threshold for “exempt” status, structuring of salaries for higher-level exempt employees, the possible reclassification of exempt employees, and numerous other issues. Presentations and discussions will also focus on actionable strategies, including how to conduct a self-audit and current duties test for current employees, best practices in evaluating current position classifications and salaries, and financial considerations. A question-and-answer session will provide an opportunity for attendees to have questions answered by a panel of ScottHulse’s experienced labor and employment and government compliance attorneys.

“The new overtime rule is an example of the growing, complex, and burdensome government regulations which employers now face – regulations which are backed by aggressive enforcement and can result in high-level penalties,” said attorney Rosemary Marin, who leads the ScottHulse labor and employment practice group. “Even the most diligent organizations now find it necessary to continually re-evaluate and update their business practices, including wage and hour practices. This seminar is part of our commitment to work proactively with businesses and their executives to conduct internal audits and help them respond quickly and appropriately to assure compliance, make necessary adjustments, and correct oversights or infractions—before the government comes knocking.”

Some seminar attendees may earn certification credits. The State Board of Accountancy has approved the seminar for two hours of credit. Approval for two Continuing Legal Education (CLE) hours for attorneys is pending as is approval of two hours of continuing education through the Human Resources Certification Institute.

The registration fee of $50 includes seminar materials, continental breakfast, and free parking at the Chase Tower. To register online, visit the ScottHulse Eventbrite page. For additional information, call 915-533-2493.
